This is because it is very difficult to stop some fan subbing and impossible to end all of it.

They don't think it's illegal they KNOW it and they aren't going out of their way because it isn't worth it and not because they get a wider audience.

Let me explain something to you... YOU HAVE LOST. They are ETHICAL, not legal. There is no gray area, they are illegal, and shall forever be that way unless some massive surge goes through all of human society and changes everything.

It is LAW. I'm a fansubber myself, and I follow series that are available to me through subbing groups, and was in fact a member (though not an active one) of a fansub group. FANSUBS ARE ILLEGAL. Just because the law isn't enforced doesn't mean it isn't there.

Article 8 of the Berne Convention, which is what Japan and the U.S. now follow, states this:

"Authors of literary and artistic works protected by this Convention shall enjoy the exclusive right of making and of authorizing the translation of their works throughout the term of protection of their rights in the original works."

I'm sorry, but you can't get any less ambiguous than that.

Now, this is not something authors MUST have. They may waive this right; it is, after all, their decision. (This is how we get organizations like Creative Commons.)

However, most authors of "literary and artistic works" living in countries under the Paris Act of the Berne Convetion, though, want and possess this right. Any infringement of it is illegal. Period.

Whether or not fansubbing is unethical is an entirely different issue.

Think of it this way. Possession and use of controled substences (drugs) is illegal but the sheer number of people that sell and use prevent legal action from being cost effective. It's the same thing here... the number of people doing it makes it dificult to prosicute, so it goes on...

You just don't get it....just because companies don't ask for people to stop distributing their material, doesn't mean it's not illegal. Point is you're reproducing something without the consent of the creator...by doing that you're breaking copyright laws.
