On topic - Personally I only use fansubbed footage when it's the only footage available. Which means it's from a recent series or one that hasn't been distributed here. Anyway I fully intend to remaster them once/if the dvd's ever are available. So basically downloaded anime is a last resort.

No, because of the OTHER law that AMVs break, which is that nobody else but the copyright owner of a work can authorize a derivative work. The only "legal" AMV is one that (a) uses totally original audio and video or (b) has secured permission from copyright holders.
