Legality of AMVs (Web host problem)

My web host has a few rules that may not let my host my AMVs... I'm not sure... I'm going to email them, but I need to know what to say to show them AMVs are not illegal.... What can I do?
Q. My website will have music and/or video files - anything special I have to do before uploading these files?

A. YES! Because of the overwhelming abuse of illegal music (etc) trading, we do ask that you contact us before uploading anything over sample length to your account. Please identify yourself as a Premium Member when you email legal@crosswinds.net. We'll send you the information you need.

Q. I've got a lot of Anime (DBZ, Pokemon, sailormoon, etc.) to put up on my site - I can do that right, because I found it on another site or made it another way?

A. There is a lot of misinformation about Anime on the internet. The long and short of it is that the programs you watch on TV and see in bits and pieces and sometimes in its entirety online is copyrighted to the companies who produced these programs. You may NOT under ANY circumstances upload full videos, fansubs, music, or any other copyrighted media to your website. The MAXIMUM length of any Anime or other copyrighted media is 45 seconds TOTAL. Regardless of what your friends have told you, it is 100% illegal to infringe on the copyrights of these companies.
That's everything that have that is related to this subject, and I am writing an email to legal@crosswinds.net right now (I am a Premium member, btw).

What can I say so that they know AMVs are not illegal?

There's nothing you can say without lying. In terms of copyright, they are illegal unless you make the footage and music yourself.

If you contact them and say "I made a video with a song and footage that I dont own the copyright to" they'll say "ok, then you can't put them on our servers". Simple as.

You either really think they won't care or you are being sarcastic... Either way, this hasn't been much help. Sorry.

I'm being serious. If you ask them they will say you can't upload an amv because you do not own the copyright.

It's the same as uploading mp3s etc... it's against copyright law.

Hey, AD's right. Technically, AMV's ARE illegal... Haven't you ever seen the little FBI warning on the front of your DVD's? Anime companies let us get away with it because it's good advertisement for their business (free of charge to them) and because we don't make money off of these.

As a technicallity, AMVs are illegal, however it seems underground enough that the copyright owners don't really seem to care (moreso the anime industry rather than the ever finicky RIAA). Sounds like the hosting site you are talking about will not be lalowing you to upload so I would suggest looking elsewhere.

This is really very simple. Put them up. If they ask you to take them down...take them down. 99% of the time they just aren't going to care unless a bunch of people (also using their service) start making complaints. Or, in the event that they are being threatened with legal action, they'll ask you to take em down.

Technically if you own a copy of the song (on CD) and the anime (on like VHS or DVD), then it's perfectly legal. What MAY not be legal is the people who download them from you. If THEY do not own the music and anime, then THEY are technically breaking the law, but not you.

Pretty much as long as you're not trying to distribute pirated material for money...no one cares.

Why do always misinterperet things for the worse? Thinking AD said CAN, I already emailed our web host, and if they aren't the unprofessional バカs (bakas) they seem to be, they will have us murdered and cremated before you can say バカヤロウ (bakayarou)!

All opposed to me using Japanese text no one can read say ヒドイ (hidoi).
