YouTube is stealing music videos from from a-m-v.org!

Post by rafpca » Wed Dec 21, 2005 5:06 pm

And not only that--the people who steal them from here are impersonating the video creators. Here's one very small example:

Yes, that's my music video. No, Phantomdarkness is not me. It's a poser. Go ahead and scroll down through the comments; Phantomdarkness takes full credit. But it doesn't stop there. Look at Phantomdarkness' profile. YES--those are OTHER music videos from a-m-v.org, from OTHER video creators! Go ahead. I behoove you to search for some of your music videos; you might be surprised as to what you find. I contacted YouTube about this and received a cookie-cut, useless response about it:

Ok Ricky, here's the formal request we must make of you in order to remove this:

Dear Mr. Alvarez:

We have received your request dated December 21st, 2005 to remove from our site the following video: http://www.youtube.com/watch.php?v=QDSpVk_FyZQ
(as identified in your email below). In order to take action on your request, we will need to receive a written communication that includes substantially the following (please consult your legal counsel or see Section 512(c)(3) of the Copyright Act to confirm these requirements):

(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

(iv) Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

(v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Such written notice should be sent to our designated agent as follows:

Heather Gillette
YouTube, Inc.
71 E. Third Avenue
San Mateo, CA 94401
Tel: 650.343.2960
Fax: 650.343.2983
Email: copyright@youtube.com

Please also note that under Section 512(f) any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Very truly yours,
Heather Gillette
YouTube, Inc.

Now, obviously, I don't hold the copyright to the video or audio I used in the video. So there's only one solution.

This is retarded. Doesn't seem like youtube gives a crap unless they can get sued for it.

That idea is hillarious though.

Hi Evanessence. Did you make these videos on youtube? They are SOOOOOOOOOo good. - Sincerely, Mr Noob.

This is why I always include highly visible credits. No one who's put one of my videos on YouTube, as far as I've seen, has ever tried to take credit for it.

(I'm very much amused that <a href="http://www.youtube.com/watch.php?v=7Zsz ... aka">"Waka Laka (for Osaka)"</a> now has over 36,000 hits on YouTube, way more than any other AMV I've seen there... )

Yeah, it's my fault for not putting big credits on there. (Though for some reason I had no problem putting credits for Imogen Heap/Tetsuya Nomura big and clear!) Some of my videos have credits, some don't--I've gone through WAY too many reinventions and production names.

I found 3 of my videos on there, before I joined...

infact the way I found out about this site was that I had a 12 yearold contact me through email (cause my email is on my videos) Credits are a good thing to have.... anyways the kid said that she saw my video there, and thats how i figured it out... i had assumed that she saw them on animemusicvideos.org as this was at the time my only host.

(I upload my own videos there now, and yes jaddziadax on youtube.com is me, its a nice host for myspace and such imo)

when i confronted the person they took them down though, have you tried asking them to take the videos down???

for the most part the person who used my videos didnt take credit for them though....

People can steal amvs on youtube almost as easily as on the .org.... Most people who put videos they didn't make on youtube don't try to take credit for them, they just find them and upload them.
its a nice host for myspace and such imo
Definitely is... I put my better videos on there... youtube is good.... :D

You can't actually download vids from that site, can you? I only get a flashplayer error - streaming being disabled on my comp. If they can't be downloaded, the org is still better.

Funny, though, I found 6 of my YYH vids in two minutes of browsing. I like how one said she found the vid on something called 'bearshare' - never heard of it. I just might start using this site to link for people who can't download my vids. I don't even have to upload them. ^_^;;

Ego Trip has a *lot* more comments on there than it does here, though. That's kind of sad. :?

Yup, found three of mine. No one seems to be taking credit for them, although for one of them the people that commented on it thought the user made it. To be fair, though, that was one I didn't put a bumper on since it was just a blurb that I don't think should really count. Of course, as expected, the other two videos that were put up there are my two most popular to date, even though they were made back in 2003.

I guess I shouldn't be worrying about new videos of mine being put up there, since after last December I've switched to using formats that would likely never be cracked open by the majority of users on there, unless Windows Movie Maker can open Matroska files.
