-Good effect for original copyright holders (advertising) (I call them just "ch" now)
I saw clips on online streaming site when I searched for a brand new music video from an artist. There were often clips with just a picture of the artist and the new song in the background. Now that´s not really a gain for the ch.
Or those stage6.com channels hosting full movies and episodes. Because the site streams XviD and DivX stuff it is just easy to upload them and see/downlaod (with no tricks like on YouTube) them in high quality.
If this study will be accepted by politics and industry, do you think there will be a guide that tells you (nearly) clear that your video violates the new copyright law?
Would be such a list a good thing?
Alright. I think it sounds good. It´s a fact that industry will never win against copyright violation like in small musicvideos or homevideos (a small holiday movie with music in background).Fair use is the part of copyright law that permits use of copyrighted material so long as the public benefits more than the owner loses. The interpretation of fair use depends on the situation, and therefore, requires interpretation according to creative practice. The CSM/PIJIP project will carry fair use into participatory content environment, in three stages.

How to protect our AMV's safe from copyright infrigement...
I was deeply disapointed and terribly about those so-called copyright infrigement (I hate that word)....it happened last month that three of my AMV's were removed(also my youtube account is suspended but my veoh account is fine - one AMV is also removed) and I'm so afraid that I have upload my new AMV (that contain from my DVD I've just ripped from my HandBrake, CD audio and so on)...I don't know what to do
Please is there another way how to protect/fix/safe my AMV's.

the deal with you<b></b>tube is that when you upload to their site you pretty much waver any rights to your videos and give them full license to distribute the video how they want to. (they can send it to news teams and allow them to use it, they can give it to late night shows to allow them to make fun of you, etc.)
Now where does this leave amvs? if you upload a material that's not strictly copyrighted by you and you alone then you have no right to give them that license. This is why screaming "fair use" does not work with them. The deal is THEY don't have the rights to the copyrighted material in amvs. (Or in any of those "lipsync" videos either... but they have made "deals" with several record companies to help them with that... they have not made "deals" with any anime companies, or ALL of the record companies.)
Read the terms of use.

I saw this on another forum. They were talking about a nick show called Avatar: The Last airbender and fair use (though I didn't know what fair use was) allowing film makers to edit to avatar without their videos being deleted or against the law. I guess its going to spread out to anime and what not if it benefits the creators of the anime.

We've been at it longer, but mash-ups of all sorts have becoming increasingly popular through hosatchel, etc. It's a real issue. CHs know that they don't want to piss off their consumers, and such this is definitely any issue where some reasonable fair use will have to happen. Creativity, especially when not for profit, is something our society celebrates. So this argument isn't going to have a definitive answer on the side of the CHs. Maybe in the US, but not in all countries.
