It depends on what you're downloading. Fansubs of Japanese anime - though we are not allowed to link to them here - are not considered illegal (or not punishable like illegal mp3 sharing programs) as long as the distributers make no money off of it and the anime is not available any other way. But once the anime is licensed here, downloading illegal copies of that anime is taking money away from the companies distributing it (in dubbed version, or dvd). Once they buy the rights to that anime, US copywrite laws deem fansubs as bootlegged copies of material they paid for.
A few years back downloading YYH would have been fine (not on this website, but most anywhere else) - now that it's been licensed and is being distributed, those fansubs would be considered bootleg the same as Chinese bootlegs (copies people pay for rather than downloading for free or buying unsubbed originals at exhorbitant prices).
Either way, we're not supposed to talk about downloading episodes or bootlegs on this website, so I'd stick with discussion over dvd, original, or dubbed (televised) anime.
