You'd also have to put all of the Federation on trial, because who can keep track of all the war crimes they committed to prevent the spacenoids from seceding. 08th MS Team and the original Gundam were great examples.The collective Anaheim staff up to before UC 0085 (roughly?)

Most of what the EF did pre-war was blockades, without any open hostility, Zeon in actually made the first open assault. Thus leading into the brutal One Week War (where, ironically, Zeon killed more spacenoids than the EF...well, that's one way to free them...)
As for using MSG and 08th as examples...again, while they had some bad apples (the most prominent for the EF being Capt. Ryer giving the order to fire on the carrier...then again, given this was after Ghinias decided to break cease fire he kind of had a hand in screwing that over) they still didn't quite match such actions as those of:
-Gihren Zabi, who openly proclaimed to his father his intent to 'purify' the human race, and who openly murdered his own father along with a good chunk of the EF fleet (throw in the fact that in order to make his solar ray he had to drive thousands of spacenoids from their homes)
-Gene, who decided to play the hero on an otherwise routine reconnaisance mission and in the process killed a good number of civilians (and, in doing so, ironically set part of Zeon's destruction into motion.)
-M'Queve, who, when faced with losing Odessa, decided to ignore the Antarctic Treaty and attempted to launch nukes on the EF fleet
-Ghinias Sakhalin, who murdered his own staff upon completion of the Asparas, and who then decided to try and take out some Feddies during a cease-fire
-Arth, the Zaku pilot who repeatedly expressed the idea that the Zaku squadron consisting of himself, Topp, and Dell, threaten to obliterate Kiki's village if they weren't provided with food.
By comparison, the EF didn't have many ruthless killers so much as corrupted desk jockeys.
