Boochsack is Cracking Down on AMVs, audio wise, that is!

People gave me a low rating on a rant I made regarding WMG and stuff, but I'm the one laughing when their AMV gets pulled.

When I get that little old message about either removing it or swapping the audio out...I just delete them darn video. There not that important to me anyway. There's only one I'd never give up though, and isn't that good per say

i just checked UTube, and I keep smirking at people, they keep uploading this song I like, "Falling Inside the Black". It's useless to upload it since it's owned by WMG and they'll just pull it off in a couple hours. I have a video that uses Shinedowns Fly from the Inside that got taken down on someone elses account. This made me giggle because out of all my videos, this one accually has sold records LOL

I had found the song before the band got big, and after a few months of editing released it just before the song hit the big time on the charts. I had so many people tell me "I bought that album because of your video."

And the kicker is I just had mozart, explosions, and panties?! oh my! Taken down as inappropriate content and my account slapped with a warning.

To which I say screw em, that was the final straw, from now on all my vids are gonna be on the org alone, or maybe one of the other streaming sites if I feel like it. I'm sure gametrailers would love 3 minutes of najica panty shots done to classical music.

ah vidders that fail to miss the point that while they might be protected under fair use (though I've yet to see this hold up in a court) The Tube itself not protected under fair use not only because they make ad revenue off of people's videos but they never paid for distribution rights therefore when they take down videos it's really only The Tube trying to cover their own asses.

When you upload a video to you tube you are essentially giving them the rights to distribute your video however they want to (including giving The Tube the right to sell your videos to entertainment shows and news broadcasts) and since you have no rights to distribute the music you have no right to give that right to someone else.

However I find all of these semantics with copyright law rather irritating :/

Who would have thought when you violate a site's TOS they take your content down. That's so unfathomable.

Though I'll argue fair use till death on the issue you can't get past a problem of violating the terms of service as it's contractual and the tube has a right to pull your work for that reason alone despite any other matters or defenses you would have against the music industry.

Fair use doesn't work in a contract dispute where you explicity state you own the copyright for the material you've uploaded.

Just a thing here: Recently, the tube disabled the audio on an AMV that I uploaded. I did that debate thing saying it was under fair use (there was only a part of the song and the "meaning was changed") and... yes, they ended up re-enabling the audio. Yes, fair use does exist on the tube too.

But it's not worth me giving them all my information. But my vids were pulled 'cause of Warner Music Group having a cow, so even if I did the fair use argument, there's no way I could get the song audio re-embedded.
