Also, let's be fair: before you are sued, chances are the .org will. Individually, you're very unlikely to get targeted before the .org does. There's no guarantee that the .org will or won't, but so far the only threatening thing that actually happened is the cease & desist order from Roadrunner records. The site hasn't been bothered since, as far as I'm aware. There's also no precedent, as far as I know, for any entity being actually taken to court over AMVs. So factually speaking, there's no precedent.
On the other hand, if you want to be paranoid, there's always room for that. You can certainly theorize that someday the .org might get challenged, and there's no guarantee that if challenged, it will actually fight (everyone likes to talk about standing up to the man until their own balls are up to the wall, so to speak). It is conceivable that the .org might lose, in any case, and that information on those who uploaded content here be disclosed on the court's orders. It is likewise conceivable that those who brought the charges in the first place could have a field day with that information.
But I'm not really going to lose any sleep over the risk of that. In any case, if you think you're completely safe doing ANYTHING - really now? Are you? And in this case not only are the risks low and precedent non-existent, but if you don't give in and keep making videos, you're contributing to a growing culture of remix media and, hopefully, adding to the difference that might just gradually lead to the legal changes we need.
