My defense:

-It's fair use
-Art wants to be free
-I don't harm anybody and my work is way more of an advertisment for the sources
-There is not a lot of money to sue from me
- and finally if they still disagree than I would pull of my videos and would "never" do it again

This group sucks. In my country they play the CSI series uncensored at the 8:15PM prime time and well... CSI is explict like a SAW movie. THAT could traumatize our children.

I have a question? What if you're poor and can't afford to buy the DVDs? You didn't illegally download the footage and music BUT you had rented DVDs & music albums from your local library in order to make an amv. Would you get in legal trouble for that?

Well for takedowns on YouTube and stuff it doesn't really matter what your source was, since whether a video is infringing is independent of whether you legally acquired the source footage. If it ever went to court, they'd have to evaluate whether the video was infringing on its own merits, though if they found it out you did not legally acquire the source footage they could add a second claim for copyright infringement against you for that.

It's a similar situation: There are not anime shops in my city, meaning, no DVDs. The only way to get the VOBs files is by requesting a DVD-rip to some familiars in USA, but never get responses. And the only DVDs available are the first season of Bleach and Naruto. But fortunately I've never got in any problem about that
