it also depends greatly on where you are, those rules need not apply in non US lands and in some places (like Japan) they are incouraged due to the fandom base that are the active members.
I submit that in general AMV's fall squarely within the realm of Fair Use on the following assumptions:
1. You are creating a new and non-competitive work of art
2. There is no profit motivation
3. AMV's can actually help to sell the original subject matter
4. The amount of footage used is in general a very small percentage of the total footage (i.e. 5 minutes out of the EVA series of 650 minutes = ~.8%)

That's a well rounded argument, and you'd go very far with it if it weren't for one killer piece of legislation in the United States: the DMCA. It's illegal to break the encryption on DVDs, despite what you plan to use it for. Unless you record your stuff from VHS, you are breaking the law (albeit an extremely flawed one).shadow9600 wrote:*good information*

its not the footage i am concerned with even tho its kida un-certain. its the music part of videos. you can come here download any song and rip it off the amv,. no different than kazaa. just because its not been enforced doesnt make it right. copy of artists music is illegal. i was misguided in this and now that i know its wrong i am only trying to make it right. doesnt matter if everyone is making videos its just wrong with the music. i dont care how many do it doesnt make it right.
