They are going to have to much of a problem trying to crack down on this that it'll just get bigger. Look what happened to napster. They cracked down on that and now we have winmx which is free and let's you dl songs, videos and pictures. I don't think they realize that just by doing this they are going to promote the growth.
The way I see it in how they don't have much of case is the fact that the music videos does not display the whole movie. Infact it only shows various parts that would mean nothing to anyone else. AMV's aren't hurting the companies who copywrited it because they aren't showing the whole things. Infact it would be more or less promoting the anime because it's giving parts in a appealing way which would help people who want to see it.
Infact I would go along saying that maybe the people who make the animes should use some of the fan made music vids to help promote them.

By and large, I think the domestic anime companies do consider AMVs (and likely other fan works) as being good better-than-free (as we pay for the source DVDs we use) promotional materials even though legally and officially they can't condone it. That's all well and good- but then you'd also have to secure the rights for the audio that was used in the Fan Made AMVs. In practice, though, it is useless, because (1) it is very vague re: its applications to AMVs (here's the U.S. fair use clause: http://www.copyright.gov/title17/92chap1.html#107 ) and (2) you need a lawyer (read: expensive) to make use of it.
Furthermore, AMVs are not subject to just U.S. copyright law. In most cases the copyrights as detailed by the Berne Convention also apply, and the definition of fair use there is a bit different ( http://www.law.cornell.edu/treaties/berne/10.html ). I'm not a lawyer, so I won't say yes or no on this, but I don't think you can say that an AMV is merely composed of "quotations".

That may sound like a tinfoil hat conspiracy, and, to some extent, it is. Consider, however, that the MPAA is working to destroy even conservative efforts to limit copyright terms (see the Eldred Act's progress). The RIAA is starting to wise up a bit, although their latest round of lawsuits place the emphasis on the "bit" part.
