I actually just finished writing a research paper partially on this subject.

The short answer is this:
The act of making an AMV, with no distribution, is 100% legal.
Distribution is not.

Clear enough?

Well, it only took hundreds of posts and several years to reach that conclusion :P

Yes, but not quite. It also depends on how you make the AMVs, and the techniques most if not everyone on this site uses are illegal. Just ripping (copywrighted) DVDs is illegal. I know it's senseless, but it's true. Even if you rip the DVD and do nothing with it, you've still broken a law.

Capturing footage from DVDs through a capture card is still legal though last time I checked.

Nit Quite....

It's not illegal to rip the DVD in the PRIVACY of your own home from a bought original... The distribution of the Ripping software may be technically illegal (it depends as you are allowed to make a backup of your original for your private use).. You can make all the AMVs you want at home with anything you have. You can show it to a few friends IN YOUR HOME. The bottom line is, no one will EVER procecute you if you if it's kept in the privacy of your own home...

The minute you put it on the Internet, make copies to give out or basically distribute beyond the confines of your home, it then becomes illegal...

Technically, if you use illegal anime (illegal porn, etc) THEN the AMV is illegal in your own home as well...

This last sentence is probably true just in practical terms. But your first sentence is not correct, at least in the U.S. where the DMCA outlaws "acts of circumvention." More here (EFF.org). (Skip down to section 2 on that page.)

If you don't tell, I won't tell.
The first rule of AnimeMusicVideos.Org is - you do not talk about AnimeMusicVideos.Org. The second rule of AnimeMusicVideos.Org is - you DO NOT talk about AnimeMusicVideos.Org.
