Copyrighted music and YouTube :(
So, I'm finishing up my second AMV and I've worked VERY hard on it and I am happy with how it turned out so far. I tried to make my WIP unlisted on YouTube so I could show my boyfriend what I had done so far, but the song is owned by Sony . I have a section in the middle where the song cuts out and there is a bit of the intro music, but I'm sure that doesn't matter. I have submitted a request to Sony to get license to the song so that I can use it and that I would not monetize for my own gain. If that doesn't work out, has anyone had any luck filing a dispute for Fair Use on an AMV? Can AMVs even be considered Fair Use? How do lyric videos and other videos get to use copyrighted music? I'm not trying to get YouTube famous or make money, I just want to put it out there and get feedback, comments, and to share it with more people.

0: totally anecdotal so take it with a grain of salt, but in my experience if you acknowledge the copyright claim by clicking video manager then the blue link next to the video in question it should be fine? they sometimes put ads on or little song info things in the video description. sometimes they also block the video in certain countries or mute the audio but its not that common unless its a super popular song? disputing the claim just opens up a big can of worms @_@

Don't be so factitious... a-m-v.org is great and all, but it gets nowhere near the exposure that YouTube does, and it's also nowhere near as easy to use or share videos. Actually I'd say if you're trying to share a WIP, a file sharing site like Google Drive or Dropbox would be better than YouTube anyway.Farlo wrote:if only there were some other site you could upload it to.
Anyways in response to the OP, you don't really need to be too concerned with the copyright claims unless it's muting the audio. If you can still hear audio, you're okay; but the video might be blocked in some countries, and it'll also put ads on the video that the copyright holder makes money off of. You can see details about this in the Video Manager if you click the "Video blocked in some countries" link. It's only really a concern if the audio gets muted, because of course, half of an AMV is the music after all.... I dealt with this years ago when I made an AMV to a Paramore song, and it kept muting the audio whenever I tried to upload it no matter what I did. In the end I gave up, and the copyright lapsed years later and finally stopped muting the audio when I uploaded it. Nowadays before starting a video I'll usually do a quick search for the song on YouTube; if the only results you get are the official video, cover songs, or pitched versions of the song, it probably has a strict copyright enforcement on it. It's up to you to decide if it's worth forgoing putting your video on YouTube to use that song, or if you want to alter the song in some way (it looks like people are still doing pitch shifting) or use a cover song instead. It sucks because most everyone goes to YouTube to see videos, but that's what happens when you appropriate other people's copyrighted works, I guess. I don't recommend filing a dispute though... you probably won't get anywhere. If a copyright holder wants to let people use their stuff and make money off the ads, they will; otherwise, they won't. I don't think there's any arguing with them.

You have to pay attention to the *some countries* list. It could easily cover the vast majority of youtube users. They're kinda sly about it too. It won't be blocked for the uploader when they do it that way, so to you it'll look like everything is fine.

try vevo or dailymotion, even mediafire, there are lot of option to share not as complicated as youtube.

Any DMCA based take-down process requires them to shoot first and ask questions later, as it were. If it's a DMCA process, you object, answer their form letter questions, and they put the video back up. Sometimes this goes through 2 or 3 rounds of back and forth. In the end, the company the owns the copyright needs to sue you in court to get the video taken down. Media companies didn't like this, so a number of them have made side deals with YouTube that allow THEM to issue take-downs that are materially different from DMCA ones. When they use those alternative methods, there are no safeguards, there is no back and forth, there is no suing people. there's just blocking.
The old way of doing things was costly (giant game of whack-a-mole) and would hurt PR if they ever had to publicly sue folks for their uploads. The new way is cheaper for them in the long run.

If you're having serious trouble then I recommend posting it on another video site, and then making a video on youtube announcing it and providing a link in the description. I've seen plenty others do this

Sure animemusicvideos.org doesn't get the exposure as it once does. However when I go to conventions I hand out my cards for my cosplay page and also on there it has the link for animemusicvideos.org. I have my username on the card so people can look up my videos on both animemusicvideos.org and youtube if the video does not get blocked. So if you want start a facebook page and link your animemusicvideos.org account there. Make announcements about your projects and new releases. Reach out to your friends and have them check out your work and maybe they'll show other friends. If you go to conventions do some AMV panels and get your name out there.
